Terms and Conditions for FlashApply by Floating Binary Software Systems Inc.
Introduction & Acceptance of Terms
Welcome to FlashApply, a desktop software application provided by Floating Binary Software Systems Inc. ("Company," "we," "us," or "our"). By purchasing, installing, or using FlashApply (the "Software"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you must immediately cease use and uninstall the Software.
Amendments to Terms
We reserve the right to update or modify these Terms at any time. It is your responsibility to periodically review these Terms. Continued use of the Software after changes are posted constitutes your acceptance of the revised Terms.
About FlashApply & Access Rights
FlashApply is a job application automation tool designed to streamline job searches and application processes. When you purchase FlashApply, you are granted time-limited access to use the Software for the specified period, either 2 years or 4 years, depending on your purchase.
Your purchase does not grant you ownership of the Software, resale rights, or perpetual access beyond the purchased period. FlashApply remains the intellectual property of Floating Binary Software Systems Inc., and all rights, including the ability to revoke access under certain conditions, are retained by the Company.
There is no license key or activation requirement—your purchase automatically provides access for the duration of your plan.
Presale Terms & Refund Policy
We are currently offering a presale for FlashApply with the following access periods:
- $99 for 2 years of access
- $149 for 4 years of access
- Money-Back Guarantee: Refunds are available within 30 days of the first public release of the Software, provided that the request is made in good faith and not to exploit the refund policy.
- Usage-Based Refunds: If a user excessively utilizes the Software during the refund period, we reserve the right to issue a partial refund instead of a full refund.
- No Refunds After the Access Period Begins: Once you have accessed and used the Software for a significant period, refunds will not be granted, except as required by law.
- No Refunds for Change of Mind: Due to the nature of digital software, we do not offer refunds for user dissatisfaction if the Software functions as described.
By purchasing FlashApply, you agree to these refund terms.
No Guarantee of Job Placement
FlashApply is designed to assist with job applications, but we do not guarantee job interviews, job offers, or employment outcomes. We are not responsible for how employers receive or respond to job applications.
User Responsibilities & Acceptable Use
You agree to:
- Use FlashApply only for personal job applications and not for commercial or third-party application services.
- Not share, sell, or distribute your access to others.
- Not modify, reverse-engineer, or tamper with the Software.
If we detect unauthorized use, we reserve the right to suspend or revoke access without a refund.
Privacy & Data Protection
We do not sell or share your personal information with third parties. FlashApply runs locally on your device, and we do not collect or store your job applications, personal data, or usage logs. However, we may collect non-personal analytics data for software improvements.
Software Updates & Support
FlashApply will receive updates and improvements during your purchased period. However, we do not guarantee new feature additions, continued compatibility with future operating systems, or perpetual updates beyond your purchased period.
We provide limited customer support via email. Support does not include installation on multiple devices beyond the allowed access period, debugging user-specific issues, or extensive technical assistance.
Limitation of Liability & Warranty Disclaimer
- FlashApply is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that FlashApply will be error-free, uninterrupted, or fully compatible with all systems.
- In no event shall Floating Binary Software Systems Inc. be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use FlashApply, including lost job opportunities, lost income, or data loss.
- FlashApply may receive periodic updates and improvements. While we strive to ensure a smooth experience, some features may be updated or modified over time. We appreciate your feedback as we continue to enhance the software.
To the fullest extent permitted by law, our total liability shall not exceed the amount you paid for FlashApply.
Access Termination
We reserve the right to suspend or terminate access in cases where:
- A user violates these Terms.
- We detect unauthorized sharing or distribution of the Software.
- Continued access poses legal, security, or business risks.
No refunds will be provided in cases of access termination due to violations.
Governing Law & Dispute Resolution
These Terms shall be governed by the laws of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved exclusively in Ontario courts. If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.
